Rane completes demolition of Juhu bungalow ‘illegal portions’

Mumbai: The demolition work of ‘illegal’ portions of the Aadish bungalow, the Juhu residence of union minister Narayan Rane, has been completed as per the Supreme Court (SC) orders. Instead of the Brihanmumbai Municipal Corporation (BMC) undertaking the demolition, Rane carried out the work at his own expense by hiring an architect and contractor.

Rane lost a plea in the SC against the illegalities in his Juhu bungalow and later, he gave a letter to the K-East ward office in November 2022 that he was complying with the SC order.

Earlier, Rane had told HT that he was making changes in his bungalow, but he, however, did not answer the calls from HT on Sunday.

While a senior officer of the K-West ward said that Rane was demolishing the illegal part of the bungalow themselves. On September 26 last year, the SC refused to stay an order on the Bombay High court (HC) ordering the demolition of portions of Rane bungalow and also gave him three months to comply with the order.

Rane had received a setback on September 20 when the Bombay high court turned down his request for retention of the portion of the property facing demolition and ordered demolition to begin within two weeks. Rane, through his family-owned company, Kaalkaa Real Estate Private Limited, questioned the high court decision in the apex court and sought a stay on the demolition.

The property in question, Aadish Bungalow, is the residential property of Rane located in Juhu, covering 1187.84 square metres. Rane contended that he got an Occupation Certificate from the BMC in 2013.

An activist Santosh Doundker had approached the BMC in 2016 and he said that BMC pursued it seriously since 2017.

The BMC issued notices under Section 351(IA) alleging alterations in some parts of the property which were unauthorised under the law. MCGM did not consider Rane’s objections in March, following which the former Maharashtra chief minister approached the Bombay high court.

The MCGM case was that the areas that were free of floor space index (FSI) under the original plans were put to use by Rane and, thus, the use of such portions without factoring the same for the purpose of FSI calculation was unauthorised.

Rane moved two applications for regularisation of the portion claimed by MCGM to be unauthorised. His latest representation was moved on July 11 which was pending with the authorities. But the high court by its September 20 order dismissed Rane’s petition and went on to dismiss his application of July 11 paving the way for the demolition of the portion. In addition, they could also impose a cost of ?10 lakh.

Santosh Doundker, the complainant in the Rane bungalow case said, “I have got a copy of Rane’s submission to the K-West ward and the ward office has filed a report on compliance in January to SC. The BMC action is over, but the collector has to tackle the issue for CRZ.”
